1. Scope

These Terms and Conditions apply to all orders placed through the online shop Happymugclub, operated by:

Dastin Plewka
An den Mühlen 5
48151 Münster
Germany
Email: support@happymugclub.de

These Terms and Conditions apply to consumers within the meaning of Section 13 of the German Civil Code (BGB).

2. Contract Partner, Conclusion of Contract

The purchase contract is concluded with:

Dastin Plewka (Happymugclub)

By placing products in the online shop, we submit a binding offer to conclude a contract for these items. You may initially place the products in the shopping cart without obligation and correct your entries at any time before submitting the binding order. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button.

After submitting the order, you will automatically receive an order confirmation by email.

3. Prices and Shipping Costs

All prices are final prices and include the applicable statutory value-added tax (VAT).

Shipping costs are displayed during checkout. Shipping costs may vary depending on the delivery country.

4. Delivery and Shipping Processing

The production, packaging, and shipping of the goods are carried out by our external fulfillment service provider Printful. Delivery is available worldwide where selectable during checkout.

Delivery times vary depending on the product and destination country and are displayed during the ordering process. Due to external production or shipping delays, delivery times may occasionally be extended.

Responsibility for shipment transfers to the customer once the goods have been handed over to the shipping carrier.

5. Payment

The payment methods displayed during checkout are available in our shop (for example credit card, PayPal, Klarna, Apple Pay).

6. Retention of Title

The goods remain our property until full payment has been received.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days. Details can be found in our withdrawal policy.

Please note that personalized products may be excluded from withdrawal where legally permitted and if clearly indicated.

8. Warranty

The statutory liability for defects applies to the goods offered in our shop.

9. Liability

Claims for damages are excluded unless they are based on intent or gross negligence. This does not apply to damages resulting from injury to life, body, or health.

10. Storage of Contract Text

We do not store the contract text. However, you may print or save the order data immediately after submitting your order. The order overview and order confirmation will also be sent to you by email.

11. International Shipping, Customs and Fees

We ship our products worldwide where selectable during checkout. Please note that deliveries outside the European Union (EU) may be subject to additional costs that are not included in our prices and must be paid by the customer.

These additional costs may include in particular:

  • Customs duties and import taxes
  • Customs handling fees
  • Local taxes (such as import or sales tax)
  • Fees charged by the shipping carrier in the destination country

These fees are charged by the customs or tax authorities of the destination country and are not controlled by us as the seller. We have no influence over these charges and cannot estimate them in advance.

The customer is responsible for complying with the customs and import regulations of the destination country. Please inform yourself about possible fees before placing an order.

The production, packaging, and shipping of the goods are carried out by our external fulfillment service provider Printful. In some countries, delivery times may be extended due to local shipping carriers or customs clearance. These circumstances are beyond our control and do not constitute a defect of the goods.

Delivery times displayed in the shop or during the ordering process are non-binding estimates and may change due to local delays, especially for international shipments.

12. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):
https://ec.europa.eu/consumers/odr/

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable Law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
